    So Apple had one of their 'come listen to me, I'm gonna change your world' events today. You can read coverage of the event on CrunchGear (if you haven't already!)

    HTC, the Taiwanese handset and PDA (personal digital assistant) maker, earlier this year launched the HTC Touch, a Microsoft Windows Mobile 6 Professional OS smartphone designed with one-touch screen features, viewed by many as a rival to the iPhone.

    Upon hearing of the name of the new iPod, HTC president and CEO Peter Chou said, "HTC Touch is a trademark, but I can't comment right now," on whether HTC might file suit against the company.

    Well the iPhone dispute didn't go anywhere either. iPhone is still called iPhone even though another company owned the TM. Either Apple paid them off, or had something else in store.

    That is just speculation, on top of that we don't know what went on behind doors. But as I said, the fact that they had the trademark previously doesn't mean anything in this case as Apple has shown. I really didn't follow up on all the news as it wasn't as sensationalized as the original dispute was.

    The first case was for a coined word "iPhone" while this one is a result of HTC also using the word "Touch" - normally under trademark legislation descriptive words such as 'touch' can't be trademarked by themselves. This time most of the press got it right by ignoring the story - PC World really stooped to tabloid type journalism on this one (It might be news if a lawsuit was actually launched, and would be news if they lost, but its not news simply proof that a company like HTC can flim flam there way to some free publicity -- if they wanted a trademark they should have gone for a strong mark not the descriptive word they chose')
